Terms of Service

These Terms of Service ("Terms") govern your access to and use of Listing Genie (the "Service"), operated by Karaaslan Services ("we", "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Listing Genie is an AI-powered tool that turns product photos into marketplace listings (title, description, pricing suggestions, and platform-specific formats). Outputs are generated by AI and may be inaccurate — you are responsible for reviewing them before publishing.
2. Eligibility and account
You must be old enough to form a binding contract in your jurisdiction. If you use the Service on behalf of an organisation, you represent that you have authority to bind it. You are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.
3. Acceptable use
You must not misuse the Service. In particular, you agree not to:
- Use the Service unlawfully or to infringe others' rights (including intellectual property).
- Upload content you do not have the rights to use, or content that is illegal, deceptive, hateful, or harmful.
- Attempt to circumvent security or usage limits, probe, scan, scrape, or interfere with the Service.
- Introduce malware or attempt unauthorised access.
- Use the Service to generate deepfakes, impersonate others, or produce material designed to defraud buyers.
You are responsible for the prompts and images you submit, for verifying the accuracy of AI outputs, and for how you use those outputs (including compliance with the rules of any marketplace you post to).
4. Intellectual property
We (and our licensors) retain all rights in the Service, including the software, models, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service within your plan. You retain rights in the content you submit. You grant us a limited licence to host and process your content solely to provide the Service. If you believe content on the Service infringes your rights, contact us and we will review and, where appropriate, remove it and take action against repeat infringers.
5. Restrictions
You may not reverse engineer, resell, redistribute, or sublicense the Service, or circumvent any technical limits.
6. Payments, subscriptions, refunds, and taxes
Paid plans (e.g. Listing Genie Pro) are billed on a recurring basis until cancelled. Payments, billing, tax, invoicing, cancellations, and refunds are handled by our reseller Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. 7. Service availability
We do our best to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or that outputs will be accurate or fit for a particular purpose.
8. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to Paddle for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, death, or personal injury caused by negligence).
10. Indemnity
You will indemnify us against claims arising from your content, your use of the Service in violation of these Terms, or your unlawful use.
11. Suspension and termination
We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time via the customer portal. On termination, your right to use the Service ends; we may delete your data after a reasonable period.
12. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes constitutes acceptance.
13. Governing law
These Terms are governed by the laws applicable to Karaaslan Services' place of establishment, without regard to conflict-of-laws principles. Disputes will be brought before the competent courts of that jurisdiction, unless mandatory local law provides otherwise.
14. Assignment; Force majeure
You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond reasonable control.
